Terms of Use - Centurion: Modern Security

These Terms of Use (the "Terms") are a legally binding agreement between you ("User" or "you") and Alex Cabrera ("we", "us", or "our"), owner of Centurion: Modern Security (the "Software" or the "Application").

BY INSTALLING, COPYING, ACCESSING, OR USING THE SOFTWARE, YOU ACCEPT THESE TERMS.

If you do not accept these Terms, do not install or use the Software.


1. Scope and Eligibility

These Terms govern your access to and use of the Software, including updates, upgrades, patches, and related services. You represent that you are legally able to enter into this agreement. If you use the Software on behalf of an entity, you confirm you have authority to bind that entity.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to install and use the Software for its intended defensive cybersecurity purpose, on devices and under license limits authorized by us.

All rights not expressly granted are reserved. No ownership rights are transferred to you.

We may release updates to improve security, functionality, and compatibility. Certain updates may be automatic. We may add, modify, limit, or remove features where needed for security, legal compliance, or operational reasons.

The Software may interoperate with third-party providers (for example, authentication or infrastructure services). Your use of third-party services is governed by their own terms and privacy notices. We are not responsible for third-party services outside our control.

Your use of the Software is also governed by our Privacy Policy, which forms part of these Terms.

8. Security Tool Notice

The Software is a defensive security tool and does not guarantee complete detection, prevention, or remediation of all threats. You remain responsible for your own security posture, backups, and incident response decisions.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted operation, error-free performance, or that the Software will detect or prevent every attack, vulnerability, phishing attempt, or malicious event.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SOFTWARE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Nothing in these Terms excludes or limits liability that cannot be excluded by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Alex Cabrera and related parties from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your unlawful use of the Software, your breach of these Terms, or your violation of third-party rights.

12. Suspension and Termination

These Terms remain effective until terminated. You may terminate at any time by uninstalling the Software and stopping use. We may suspend or terminate your license immediately if you breach these Terms, present security or legal risk, or engage in abuse.

Sections that by nature should survive termination will survive, including intellectual property, disclaimers, liability limits, indemnification, and dispute provisions.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain, excluding conflict-of-law rules. Mandatory consumer protection rules of your country of residence remain unaffected where applicable.

Unless mandatory law states otherwise, disputes will be submitted to the competent courts of the provider's domicile in Spain.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Software or website. Continued use after the effective date means you accept the updated Terms.
